Essentially, if there's no clear legal mechanism for transferring the property, the court steps in to oversee the process, ensuring everything is handled correctly and legally.
The Role of the Personal Representative (Executor/Administrator)
At the heart of the probate process is the appointment of a Personal Representative. This individual, whether named as an "Executor" in a will or appointed as an "Administrator" by the court (if there's no will), is granted the legal authority to manage the deceased's estate, including the sale of real property.
This role carries significant responsibility, and the court provides oversight to protect the interests of all heirs and creditors.
Key Steps in Selling Probate Real Estate in South Orange County:
While every probate case is unique, here's a general overview of the steps involved when selling real estate:

Accepting an Offer & Court Confirmation (if applicable): Depending on the authority granted to the Personal Representative under the Independent Administration of Estates Act (IAEA):
Full Authority: The Personal Representative can often accept an offer and proceed with the sale without direct court confirmation, provided all interested parties receive a "Notice of Proposed Action" and do not object.
Limited Authority: The sale typically requires court confirmation. This means a court hearing will be scheduled, and other potential buyers may have the opportunity to "overbid" the accepted offer in court.
Closing the Sale: Once any necessary court confirmation is obtained, the sale proceeds to escrow. The funds from the sale are then used to pay off any outstanding debts, taxes, and court fees, with the remaining proceeds distributed to the heirs according to the will or state law.
